How To

Request an Investigation

Important Notice

The State Election Board has no authority to order a new election, change an election result, or conduct a criminal investigation. A request filed with this form will not alter the results of an election.

Requesting an Investigation

Under section O.C.G.A. § 21-2-31, the State Election Board has authority to conduct investigations into the administration of primary and election law and fraud and irregularities in primaries and elections. It shall be the duty of the State Election Board to report violations of the primary and election laws to the Attorney General or the appropriate district attorney who shall be responsible for further investigation and prosecution.

Preparing to File a Request

Prior to Filing

To file a request, you must use the State Election Board online or printed request forms linked on this page. The request must:

  • Include all of the information required on the form, including the name of each Respondent;
  • Have attached to it all of the exhibits and material upon which the request is based;
  • Be signed by the person filing the request;
  • Be based on conduct that occurred within two years of the date the request is filed.

If the required description (approximately 5 single-spaced pages or 10 double-spaced pages) or attachments (24 MB) are too large for online filing, a printed and mailed request might be the best option.

Information to Include in Your Request

Please indicate the following in your description:

  • Identify the individuals involved in the request (by name or other identifying information).
  • Indicate the date on which the incident(s) occurred.
  • Indicate the location of the incident.
  • Describe the facts of the incident in detail.

Filing the Request

Filing Online

The easiest way to file a request is to use the State Election Board’s online Investigation Request Form. Online filing gives you confirmation that your request was received, and lets you attach exhibits up to 24 MB.

Filing via USPS (Hardcopy)

Filing via USPS is the only way to file an anonymous request. The Board may be limited in its ability to investigate based on the provided information and its inability to follow up with an anonymous requester.

You may download, manually complete, and mail in a hardcopy of your request. Please return the completed form to:

After You File Your Request

Requests filed with the Board will be acknowledged after they are filed or received.

The State Election Board’s investigations are confidential until disclosed and action is taken by the Board. A copy of the request will be provided to the person or entity against whom it is brought. Due to time constraints and workload, it is not possible for the Board to provide periodic updates to requestors on ongoing investigations. Every reasonable effort is made to notify requestors if the matter is placed on the agenda for a Board meeting.
